Welcome to Lunara Nether. These Terms of Service govern your access to and use of our digital literary magazine and related services. Based in India, Lunara Nether explores the tension between light and shadow through poetry and prose. By accessing our Threshold, you agree to these Terms and our Privacy Policy. We curate human experiences, seeking clarity in obscurity. If you do not agree to these Terms, you must immediately cease all access. We reserve the right to modify these Terms as our digital landscape evolves.

1. Acceptance of the Threshold: By using Lunara Nether, you represent that you are at least 18 years of age or have reached the age of majority in your jurisdiction. Our platform is intended for an audience appreciative of literary nuance. Your continued use constitutes acceptance of these Terms. We navigate the shadows of creation together, and we ask that you respect the boundaries of this sanctuary. Any unauthorized use of the platform and its intellectual properties will lead to termination of access.

2. The Submission Covenant: We seek poetry and prose that dwell in the margins. You warrant that your work is original and has not been published elsewhere unless explicitly allowed. We strictly prohibit AI-generated content; we value the raw clarity of human restraint. By submitting, you grant Lunara Nether first serial digital publication rights for our quarterly issue and a non-exclusive right to archive the work on our website. All other rights remain with the author. We request acknowledgement of Lunara Nether in any future reprints.

3. Intellectual Property: All content on the Threshold, including logos, site architecture, and typography, is the property of Lunara Nether and protected by Indian copyright laws. You may not reproduce or distribute our platform without written permission. We encourage the exploration of meaning, but that journey must respect the boundaries of creative ownership. The archives are maintained for your reflection, not for commercial exploitation or derivation without consent.

4. Payments, Fees & Currency

4.1 Current policy
At this time, Lunara Nether:
• Does not charge submission fees for sending work to the magazine; and
• Does not provide monetary payment to contributors for accepted work.

By submitting, you acknowledge that your participation is voluntary and uncompensated, and that acceptance is based solely on editorial judgment.

4.2 Future changes
In the future, Lunara Nether may introduce:
• Submission fees; and/or
• Contributor payments, honorariums, or other forms of compensation.

If we make such changes, we will:
• Clearly state any applicable fees or payments at the point of submission or agreement; and
• Update these Terms and any relevant guidelines on the site accordingly.

5. Sanctuary Conduct: We maintain a zero-tolerance policy for harassment or hate speech. The Threshold is a space for quiet reflection. Users disrupting this atmosphere or breaching security will have their access terminated. We explore tension and shadow within a framework of mutual respect. Any attempt to use our platform for unauthorized commercial promotion or spam is strictly prohibited and will be met with permanent exclusion from the archive.

6. Infrastructure and Law: These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. We make no representation that our content is appropriate for use in all locations, though we welcome global readers. Indian Standard Time (IST) serves as our reference for all deadlines and publication schedules. The India Information Technology Act governs our digital operations and data handling.

7. Limitation of Liability: Lunara Nether is provided on an “as is” basis. We are not liable for incidental damages resulting from your use of the platform. Our total liability is limited to the amount you paid us within the preceding 12 months. We strive for revelation, but acknowledge the inherent obscurity of technology. We do not guarantee that the site will be free of technical shadows or delays in the delivery of digital goods due to external service interruptions.

If you have subscribed to our Threshold updates, we may send quarterly announcements. We do not sell our contributor lists or reader data to third-party shadows. Every piece of data we hold is intended to foster the literary community we are building together from our headquarters in India.

3. Archival Integrity: As a digital magazine, accepted work becomes a permanent part of our literary archive. Biographical information and author names associated with published work will remain publicly accessible on the Threshold as part of the historical record of Lunara Nether. However, private contact information and rejected manuscripts are shielded and treated with complete confidentiality, removed from active systems according to our internal data retention cycles.

4. Digital Markers (Cookies): We use minimal cookies to ensure the Threshold remains accessible and functional. These markers help us understand engagement levels within our archive without identifying individual readers.
